These Terms and Conditions regulate the use (including mere access) of the website www.mjsmed.pt, including the content and services made available on it.

The User who accesses www.mjsmed.pt acknowledges and accepts these Terms and Conditions as well as the Terms and Conditions in force at the time.

The content and services that M.J.S. Med makes available to the User on www.mjsmed.pt may also be regulated by specific conditions which, in case of conflict, will prevail over the Terms and Conditions. The User, each time they use any Content or Service, also acknowledges and accepts the corresponding Specific Conditions applicable.

The User should carefully read the Terms and Conditions each time they intend to use www.mjsmed.pt, as well as, if necessary, the corresponding Specific Conditions each time they intend to use any Content or Service.

M.J.S. Med reserves the right to modify, at any time and without prior notice, the presentation and configuration of the website www.mjsmed.pt, as well as these Terms and Conditions.

 

Use of the Website www.mjsmed.pt

Unless otherwise indicated, the use of www.mjsmed.pt will be free of charge, without prejudice to the connection cost of the corresponding electronic communication network through which the user has access.

The user is aware of and expressly accepts, voluntarily, that the use of www.mjsmed.pt is always carried out under their sole and exclusive responsibility.

When using www.mjsmed.pt, the user agrees not to engage in any act that could harm or damage the image, interests, and rights of M.J.S. Med or third parties, or that could harm, damage, disable, or overload the M.J.S. Med website or in any way prevent the normal use of www.mjsmed.pt.

Links (such as hyperlinks) from M.J.S. Med to other sites do not constitute approval by M.J.S. Med of those sites or their content.

These links are provided solely for the user's reference and convenience. M.J.S. Med does not control these sites and is not responsible for their content.

The existence of links on the Service to these sites does not imply that M.J.S. Med approves any material presented there or that it has any association with their operators.

It is the user's responsibility to evaluate the content and usefulness of the information obtained from these sites.

The use of sites controlled, owned, and operated by third parties is governed by the Terms and Conditions of Use and the Privacy Policies of those sites and not by the Terms of Use of M.J.S. Med.

Access to these third-party sites is the sole responsibility of the User.

M.J.S. Med expressly disclaims any liability arising from the use and/or viewing of any site or other material associated with links that appear on the Service. The User hereby agrees to release M.J.S. Med from any liability that may result from the use of links that appear on the Service.

The establishment of the Hyperlink does not imply, in any case, the existence of a relationship between M.J.S. Med and the owner of the website on which the Hyperlink is established, nor the acceptance or approval by M.J.S. Med of its content or services.

M.J.S. Med reserves the right to prohibit or disable any hyperlink to www.mjsmed.pt at any time, especially in cases of illegality of the activity or content of the website where the hyperlink is included.

 

Personal Data

M.J.S. Med may request some personal data from the User. M.J.S. Med will provide the User with the necessary information so that, in advance, they can expressly consent to the processing of their personal data for one or more specific purposes by M.J.S. Med.

The data collected is processed automatically and is intended for the establishment of the User/Client relationship, for future contacts, including direct marketing actions, offers of related products and services, even if indirectly, with M.J.S. Med's activity.

The data collected is also intended to comply with legal obligations and to be used in contractual relationships, with M.J.S. Med committing to maintaining strict confidentiality regarding all data, reserving access to it exclusively as necessary for its normal activity.

The user expressly and in advance authorizes the transmission of their personal data to commercial partners of M.J.S. Med, also expressly authorizing that the data be used by M.J.S. Med, even after the expiration of the membership contract, for advertising, marketing, or promotional purposes.

In case of non-compliance by the user, the data may be transmitted to third parties for the purpose of debt collection.

The respective holder is assured, under the applicable national and international legislation (in particular Law 67/98 of October 26 and Regulation (EU) No. 2016/679 of April 27, 2016), the right of access, rectification, deletion, limitation, or opposition to processing as well as the right to data portability.

M.J.S. Med will only contact the User through any online/electronic means/device when the User has expressly consented to this in advance.

 

General Provisions

The failure to exercise, or the late or partial exercise, of any right that assists M.J.S. Med under this agreement or any applicable provision does not constitute a waiver of that right and does not prevent its subsequent exercise.

This agreement constitutes the entire contract between the User and M.J.S. Med concerning the matters regulated therein.

 

Changes to the Terms of Use

These terms of use may be updated at any time by M.J.S. Med without prior notice to Users, in response to legal requirements or operational changes. The User will always have access to the current terms of use online.

This document will always be available online and can be freely consulted and may be saved or printed at any time even without being registered on the site.

Any changes will be communicated to registered Users by posting online.

Subsequent access and use of the site by the User will be considered an unequivocal sign that they have read, accepted, and understood the amended Terms and Conditions, unless the changes imply a change in the personal data processing policy by M.J.S. Med, in which case the User's express authorization will be required in advance for the alteration of the processing or the purposes of processing personal data.

 

Partial Invalidity

The invalidity, in whole or in part, of any of the clauses of these Terms and Conditions will not affect the validity of the remaining provisions, which will be fully applicable unless the interested party demonstrates that the purpose pursued by the parties suggests that they would not have entered into the agreement without the flawed part.

 

Applicable Law/Jurisdiction

These Terms and Conditions are governed by Portuguese law.
